What Can We Do About Covid19 2nd Wave ?

OBJECTIVE of this Note:

With so many messages and updates that everyone in the world are now getting on Covid19, there is lack of clarity among most of the non-medical citizens.  Moreover, there is unnecessary panic and stress among many.   


So, for my consumption, I have jotted down some points here to de-clutter my mind from Covid19 messages, and to remain calm and informed.

 

Fortunately, only a few situations are NIOC; rest are all IOC, as could be seen in this write-up.

 

FACTS, OPINION, INFERENCE, & INFORMATION:

 

·      Covid19 virus is a pandemic, and it is going to be around for (at least) a couple of years.   We should accept this fact, and go ahead with our life.( NIOC).

 

·      If one takes proper precaution, one may never catch Covid19 (even if the pandemic remains for few years).     (IOC)

 

·      The vaccines that are released now (April 2021) are Phase-III Trail Vaccines.   Typically, as per Google search, the Phase-III period spans 3 to 5 years.    By then, the scientists and researchers on Covid19 would get a better data on the virus, virus mutations, efficacy of various vaccines and also their limitations, side-effects, etc.  Accordingly, they would tweak the vaccine regularly for better efficacy.  (NOIC).

 

·      Some persons (diabetic, obese, lung ailments, … ) may have side-effects upon taking vaccinations.  These are high risk category persons.  (NIOC)

 

·      As of now, there is no specific medicine for Covid19 virus.  Only the Doctors can prescribe the medicines that best suits one.  (NIOC)

 

·      Do take the medicines strictly as prescribed, till the Doctor advises one to stop further medicines.  (IOC)

 

·      Do NOT attempt self-medication.  Do consult a doctor; and proceed as per his prescription.

 

·      For the next couple of years, face mask would have to be worn.   In case of Covid19 red-zones, masks may also have to be worn inside one’s home too.  Maintain social distancing at home too.   (IOC).

 

·      Everyone to follow the Safety Guidelines shared on www.mohfw.gov.in  .   Social Distancing, Use of Masks, Washing Hands before touching face (or mouth or nose or eyes).   (IOC)

 

·      Wear double masks, if one is visiting a risk prone area.   (Cotton mask plus Surgical mask is the correct double-masking).   Wear the mask properly covering the nose and mouth; it must fit tight.   (Visit www.mohfw.gov.in   for further info on these aspects).   (IOC)

 

·      Incorrect Double-masking.   Cotton+ Cotton.   Surgical + Surgical.  Surgical + cotton.  (IOC)

 

·      Double masking not required if one is using N95 mask.  (IOC)

 

·      If possible, we must (a) remain indoors as far as possible,  (b) avoid physical meetings of person(s), (c) plan purchases of essentials in bulk instead of small quantities such that the visits to shops or contacts with delivery boys can be reduced, (d) avoid social gatherings, parties, visit to clubs, bars, hotels, …  (IOC, how much ever is possible).  

 

·      Refer reliable websites like www.mohfw.gov.in for information, if any.   One need not continually look for Covid19 updates (unless one is doing an extensive research).   The headlines in any Daily Newspaper will have the gist of the latest Covid19 update; that is enough.  It helps in reducing the stress or panic.  (IOC).

 

·      Remain positive.  Do not panic even if one (or a family member) contacts Covid19.   Panic will reduce the immunity levels.   Do not confer with many people in such case.   Seek the opinion of a doctor and wisemen in your circle. (IOC).

 

·      If sense of smell and taste is lost, then one has Covid19.   Try to seek medication soon.  Do not wait for any tests. Never panic.   (IOC)

 

·      Similarly, if SpO2 level drops below 95, watch closely.   Check the levels once in 3 to 4 hours in such cases.   

 

·      If SpO2 level drops below 93, seek medical guidance immediately.  Delay in seeking medical guidance can result in severe complications because after this stage, the SpO2 drop could be faster.  Every hour might matter in severe cases and risk-prone cases.   (IOC).   ******

 

·      Take the vaccinations that are offered as per one’s personal preference.   Take the second dose of vaccination within the prescribed period.   Do not bother about its efficacy; it is better than nothing.    At least, one can avoid hospitalisation or ICU.  (IOC)

 

·      Even if one takes both the vaccines,one should wear mask and follow the Covid19 Safety Guidelines.  (IOC)

 

·      Even if a person recovers from Covid19, he has to take the vaccinations.  (IOC).

 

·      Do not discuss about Covid19 every day.   Discuss other topics of interest.  We must remember that not everyone is mentally strong; some may get into depression, panic stage, …  which are avoidable.  (IOC)

 

·      Have the contact numbers of doctors, hospitals, clinics, test centres, medical insurance official, medical shops, etc handy such that one need not panic when Covid19 affects one.   Also, the relevant apps that can be used for such emergencies.  (IOC).

 

·      We must safeguard ourselves.   We must also see that we do not transmit Covid19 virus to others.  (IOC)

 

·      Like earlier pandemics, Covid19 will also brought under control in a year or two.  Some new pandemics may surface in future.  And the world will deal with them too.  (NIOC)

 

·      When in doubt, visit www.mohfw.gov.in which has latest information, FAQs, Circulars, Guidelines, etc on Covid19.   It is updated every day.  Thus, we will be correctly informed, and do not get carried away by rumours and incorrect messages on social media.  (IOC).

 

·      Go ahead with one’s life (by taking the precautions).   Panic and Stress adversely affect one’s immune system.   (IOC)

MN2M on RELIGION

(MN2M  =  My Notes To Myself)

Newspapers, News Channels, …  speak of the unrest  in every part of the world and society, in the name of Religion, Politics, Caste,  … , shocking gang rapes, unwanted hate speeches, illogical fanaticism, mutilated bodies of soldiers,  ….   I have vented out my mind through this blog post.

I always prefer simplicity in everything in life; in understanding and defining Religion too.   This post is  my personal opinion on Religion based on some facts and my reasoning/logic.

Logic.  Every person follows a religion to which his parents belong.  I am a Hindu because I am born to Hindu parents.  If a child is abandoned in an orphanage (by his biological mother) soon after his birth, the orphanage would give him a name.   If it is an orphanage run by Hindus, the child would get a Hindu name; a muslim name, if the orphanage is run by Muslims.  And, so on.

Fact.  My friends  (viz. Saleem Koya, Ahmed Abbas, Rehman, Mohd Husman, Thomas De’costa, Manoj Francis, Fredrick, Jesudas, Ram Prasad, Vinay Karan, Kuldeep Singh, Nadir Khajani,  Hunaid Deesawala, Hemant Gupta, Niraj Kapasi, Kushal Das Gupta, … )  follow different religion.  No religion speaks ill of other religions.   We perfectly understand this TRUTH and the secularism among ourselves. 

Fact.  One follows religion to lead a proper life in the manner that the CREATOR expects its subject to live, perform the duties in one’s lifetime,  ... ,  and to eventually qualify for a place in heaven after death.

Logic.   When Adam and Eve, the first among the humans on earth, lived on earth, there existed everything.   The land, the plants, the animals, the forests, ... , the other planets, the Sun, the Moon,  … , the cosmos.   In other words, the CREATOR did exist before Adam and Eve were born.   Religions came later but the CREATOR existed thousands of years earlier.    

Fact.  Various messengers of God (the CREATOR) lived among the people.   People were spread across continents.   Over a period of time, people treated the messengers-of-God as GOD himself.   And, thus many religions and sub-religions surfaced over these years.   And, we have many GODS now, when in fact,  they were actually messengers of the CREATOR.  And, the CREATOR is one.

Various people, organisations, political parties, …   have systematically injected differences among the people of different religions  for their selfish motives.   This is no different from  ‘market segmentation’  as in Marketing.  

Me and my family have insulated ourselves from these illogical aspects.   We believe in secularism.  Our friend circle testifies it.  In fact, spouses of some of my cousins belong to different religion, caste, state, ….  And, we have no problem.   Life is so beautiful and peaceful among us.

Through this post, I wish the reader to form his OWN  OPINION  on every aspect of LIFE including  RELIGION.   That will provide us the clarity in our mind.   And, thus we will  NOT to be carried away by non-secular people, organisations, political parties, ….    Thus, we will NOT be used as pawns by others.  Every person will thus be a CEO of his life.

A Non-Technical CEO in Infrastructure Organisation?

A good number of Infrastructure companies in India are based out of Andhra Pradesh.   Most of their promoters started business as small contractors, and over a period of time as they grew in size, they converted into Pvt Ltd or Public Ltd companies.    The opinion expressed here pertains to such companies based out of Andhra Pradesh, in particular; and to all such companies in other Indian states, in general.

The general belief among the Directors/Promoters of Infrastructure companies (including the company where I work, www.vishwainfra.in) is that its CEO has to be a TECHNICALLY qualified person.  I have heard this opinion umpteen times in various discussions where the stress on the ‘technical’ aspect is emphatically made, explicitly or implicitly. 

I too believed in this general opinion until a couple of years ago.   Recently, I did articulate my opinion in a discussion with a Director that the ‘technical qualification’ should not be among the non-negotiable qualification criteria in CEO selection.   I also quoted few successful and big names in our industry where the CEOs are non-technical persons.   My purpose was to convince my directors to consider non-technical professionals also when they scout for the CEO position.

Last week,  I read the book  “Who Says Elephants Can’t Dance”  authored by  Louis Gerstner Jr, who was the Chairman-CEO of IBM from 1993 to 2002.   IBM was heading towards a collapse when he took over as CEO in 1993.   He was asked by the Board of Directors to  ‘save the company’.   Over a period of nine years, he successfully turned around the company.  And, in 2002, he relinquished the CEO position to Mr Sam Palmisano.    The book is about how he turned around that huge organization.   A wonderful book.   I would unhesitatingly recommend all managers and leaders to read it.

Mr Louis Gerstner was an outsider in IBM; I mean, he had not served in IBM before he took up the CEO’s position.  His was a lateral placement.   After graduating from Harward, he joined McKinsey and worked there for almost a decade.    At the age of 35, he joined American Express and served there for almost a decade.   And, in 1993, he joined IBM as its Chairman and CEO.  He had a successful career in all these reputed organisations.

But why am I talking about Louis Gerstner in this blog?   I have a reason.  He was NOT tech/IT savvy person but he headed one of the largest and oldest IT organisations in USA.    Not only he took over the reins of IBM during difficult times, but also successfully turned around the organization.

Louis Gerstner’s story further cemented my belief that a CEO need not necessarily be a tech savvy person in an Infrastructure organization.  Hence, his reference here.   Well, a CEO has to understand the business processes, its revenue model and the industry dynamics.

LESSONS From The ‘1984 BHOPAL GAS TRAGEDY’ at Union Carbide Ltd’s PLANT (MN2M)

Seven officials of Union Carbide Ltd (UCL) were convicted and sentenced two years jail term on 7th June 2010. The court awarded this sentence after almost 25 years. The gas leak in Bhopal unit of UCL had occurred on 3rd Dec 1984 which had resulted in more than 35000 deaths in the neighboring slums.

The seven accused includes the business leader Mr Keshub Mahindra (who was non-executive Chairman of Union Carbide in 1984). Mr Keshub Mahindra is the current Chairman of Mahindra & Mahindra, the car-and-utility-vehicle manufacturer. The other six accused were employees of Union Carbide, Bhopal.

This note is not about the cause of the gas leak or about the award or the lives lost or about the accsued. The note is on the lessons one can take to pre-empt such incidents in future.

a. Adequate safety measures must be taken as per the industry standards and specifications in such installations.
b. Adequate factor-of-safety must also be taken into consideration in such installations.
c. Adequate back-up systems to contain leakages, fire, explosion, … must also be in place. The management must not compromise in these aspects.
d. Preventive Maintenance of these installations must be performed regularly. A very detailed checklist(s) must be in place for ensuring the desired Preventive Maintenance.
e. Strict and regular Safety Inspections must be conducted. Inspection checklists must be thoroughly designed and must take into consideration every remote/minute aspect that could cause an accident.
f. The top management must have a system to ensure that the Safety Inspections and the Preventive Maintenances are carried out strictly, regularly, in its letter and spirit.
g. A third-party Inspection agency may also be considered to eventually ensure the desired Safety Systems and Preventive Maintenance systems in such installations.
h. Habitation in the immediate vicinity of such factories must be discouraged.
j. In the industry forums (national and international), measures to enhance the safety of such installations must be discussed and the reports must be published. It will facilitate continual improvement in Safety Standards.

Through such safety measures, the lives lost could have been avoided and the effects of the gas leak could have been contained significantly. The UCL officials would also have done their duty and would not have been accused and convicted by the court.

Senior officials in such organizations would have to take the lead and have the desired safety systems and procedures in place. It makes no sense to spend a career in litigations, court visits, … with the fear of a probable jail-term hovering over the head all the time, with guilt, …. Definitely not.

What I have penned here, is an ‘ideal approach’ . There could have been some ‘practical issues’ which would have resulted in some compromise of safety systems somewhere. That’s a moot point.

WILL - Information and Sample Formats

A ‘WILL’ is “the legal declaration of the intention of the testator, with respect to his property, which he desires to be carried into effect, after his death.”

In lay terms, a will or a testament is simply a document that a person can make to declare how he would like to dispose off his property after his death.

It is advisable to leave behind a will and not legal battles for our successors.

ORGANISE YOUR IDEAS FIRST:
Get your ideas organized before you sit down to make a Will. Outline your objectives, make an exhaustive inventory of your assets, your outstanding debts or other liabilities. Make a list of your family members and other beneficiaries.

Ask for yourself how you want your assets to be distributed. Consider how it could be made as tax exempt as possible. When you have young children, consider the formation of a trust, the appointment of guardians, etc.

Outstanding debts should naturally be paid by your estate before the beneficiaries get their dues. The name of the beneficiaries should be very clear and specific so that there is no mix-up or contests.

The person who makes the will should not be a minor, should be of sound mind, and free from fraud, coercion or undue influence.

HOW TO WRITE A WILL?
There is no prescribed form for a Will. For the WILL to be effective, it has to be properly signed and attested. It should also be initialed by the testator (the person writing the Will) at the end of every page and next to any alteration or correction made in it.

The WILL can be written in any language. It can be written in ordinary, simple language, without technical or legal words. But the terms should be very clear and unambiguous so that no doubts are raised over the meaning, and so that the intention of the testator is reflected in the WILL.

No stamp duty is required on a WILL. It need not be made on Stamp Paper.

The WILL should be attested by two (2) witnesses. These 2 individuals must witness the testator executing the will. The witnesses should sign the will in the presence of each other and the testator.

A witness cannot be an executors or a legatee of the Will under Parsi and Christian Laws. Hindu law, however, allows a legatee to be a witness to the Will.

Under Muslim Law, a Muslim is not required to have his Will attested if it is in writing.

REGISTRATON OF A WILL:
In India, it is not compulsory to register the WILL even when it refers to immovable properties. Non-registration does not make the WILL invalid or gave any inference about its genuineness.

Though no special sanctity has been given to the WILL by registering it before appropriate authorities, the testator himself evidences the genuineness of the WILL.

Once the WILL is registered, it is placed in the safe custody of the Registrar. It follows that it cannot be tampered with, altered, destroyed, mutilated or stolen.

Any WILL has to be proved as duly and validly executed as required by the Indian Succession Act.

If you wish to register your WILL, is to be done with the Registrar or Sub-Registrar for a nominal registration fee, in the registrar’s office, by the testator personally alongwith his 2 witnesses.

The testator, at any time when he is competent to dispose off his property can revoke, alter or change the WILL by executing a new WILL, and revoking his earlier WILL and registering the new WILL (if he had registered the old WILL). Or he can destroy the old WILL (if it was not registered earlier). Or he can make a codicil.

A codicil is an instrument made in relation to a WILL, explaining, altering or adding to its dispositions and it is deemed to be part of the WILL. Like the WILL, the codicil has to be executed by the testator and attested by witnesses. A codicil is governed by the same rules as a WILL.

A WILL stands revoked on the marriage of a Parsi or a Christian testator. This does not apply to Hindus, Jains, Sikhs and Buddhists.

The executor is the legal representative for all purposes of a deceased person (the testator) and all the property of the testator vests in him. The executor is appointed in the WILL.

A probate is mandatory in Mumbai, Calcutta and Chennai for a WILL to be executed by a Hindu, Christian or Parsi. Official evidence of an executor’s authority is granted by a probate.

A probate means a copy of the WILL, certified under the seal of a competent Court with a grant of administration of the estate to the executor of the testator.

The laws applicable to a WILL are The Indian Succession Act, 1925, Hindu Personal Laws, Muslim Personal Laws, The Indian Registration Act, 1908.

When a person dies without making a WILL, he is said to have died intestate, and certain rules apply in the disposal of the property left behind by the deceased.

It is advisable to get the legal advice of an attorney to make your WILL absolutely foolproof so that no loopholes are found by conniving individuals to hamper the execution of a testator’s last wishes.

I maintain good health, and possess a sound mind. This Will is made for me of my own independent decision and free volition. I have not been influenced, cajoled or coerced in any manner whatsoever.

I hereby appoint my sons ………………….. and ……………………….. as the joint Executors of this Will. (Not mandatory).

The name of my husband is ……………………….. We have two sons namely, (1) …………… and (2) ……………………. and one daughter ……………………….

I own the following immovable and movable assets:

I own bonds worth approximately Rs. ……………………. (in words) in IFCI.

I have various fixed deposits with HDFC Ltd amounting to approximately Rs. ……….. (in words).

I have invested most of the assets mentioned above in Joint Names with my various children, grand children and great-grand children. The entire amounts in these investments belong to me and these joint names are only for operational convenience. I have been very fortunate in my life and am proud of my children, grand children and great grand children and pray that they peacefully co-exist with each other and also since when I die, I would have died after living a very fulfilling life, I do not want them to grieve even for a day.

I do not understand English and this Will has been drafted as per my instructions and I have in witness whereof hereunto set my hands on this ………….. day of …………, 20.. at Hyderabad after the contents of this Will were explained to me by Sri ……………….., in the presence of many of my family members.

Greetings Card Content - Jan 2008 - 'Maintaining Marketability Till Retirement'

MAINTAINING MARKETABILITY TILL RETIREMENT
Instead of sending an SMS on this New Year, I thought of sharing my mind on a subject that would invariably be relevant to all.

Each year, we attempt an introspection and a SWOT analysis to decide on a New Year Resolution. Among the resolutions, one of them would invariably be to enhance our skillsets and knowledge so as to maintain our marketability & relevance in this dynamic world.

We would live beyond 75 years of age. Very few can plan to retire at 58 years and to live (not sustain) purely on pension/savings/investments. Here, I particularly refer to those who are not entrepreneurs or businessmen. Thus, it is imperative to defer our retirement beyond 65 years; may be to 70 years, so long as health permits. And, to touch our savings/investments after that ‘deferred-retirement’.

Therefore, we have to continually and consciously enhance our knowledge & skillsets such that our experience & services would remain relevant to any organization, even at 70.

On this New Year, I wish you the very best in choosing the right resolution(s) and in its accomplishment during the year.

I also wish Good Health and Blissful Life to you and your family on this occasion.

Water – the Elixir of Life – is scarce. It’s hard to believe but that is the fact. Even though the earth is surrounded by a vast expanse of oceans and seas, availability of potable water is scarce; and on top of it, a substantial amount of potable water flows into the seas every year. All of us should therefore consciously conserve water lest it be too late.

We take the availability of potable water for granted but, non-supply of tapped water, even for a day, significantly disrupts our routine. Most of us unknowingly waste water everyday; almost all of us can brush our teeth, wash our hands, take bath, wash the utensils, wash the clothes, wash our car, … with much less water than what we consume now.

Let us learn to conserve water at home and at our workplace. Let us inculcate in our children the habit of conserving water. And, let us do it consciously and with determination. Let water conservation become a habit in every Indian, like brushing the teeth in the morning.

It is our company’s good fortune that we are in the Water related industry. Let all of us resolve that from this day, we shall consciously conserve water – for the present as well as for the future generations.
